- Action must be taken to remedy bullying
- If bullying is occurring based on disability there is an obligation to investigation
- Was it based on disability?
- Was the bullying sufficient to create a hostile environment?
- Is an administrator aware of the issue?
- Did the administrators remedy the situation?
- If bullying is occurring and impacting FAPE, then additional obligations
- Did the school know or should have known it affected FAPE or services?
- Did the school know about adverse changes (like stopped attending school, drop in grades, etc)?
- Promptly reconvene team to review plan (IEP or 504)
